I. Subject, acceptance and effect of the general terms and conditions

Please read these General Terms and Conditions carefully before using the site www.bya.bg. If you do not agree with these terms and conditions, please do not use the site.

Acceptance and agreement with these General Terms and Conditions is a mandatory condition for using the site.

The General Terms and Conditions come into force from the moment the User uses the site for the first time and are applicable to each subsequent visit.

The site www.bya.bg is owned by the Bulgarian Yachting Association.

These General Terms and Conditions constitute an agreement between you (as users and/or visitors) and the Association of www.bya.bg and govern the terms and conditions under which the association offers the information and services on or through the site.

By accepting these General Terms and Conditions, the User expressly consents to the processing of his/her personal data in accordance with the requirements of the Personal Data Protection Act and Regulation (EU) 2016/679 (GDPR) and confirms that he/she is at least 18 years old.

By providing information through the site, the recipient agrees that the association may contact him/her in connection with the information he/she has sent.

These General Terms and Conditions are effective from 1.11.2025.

III. Definitions

For the purposes of these General Terms and Conditions, the following terms are used with the following meaning:

  • “WE”, “SUPPLIER” “ASSOCIATION”, is the Bulgarian Yacht Association;
  • “SITE”, “PAGE” is the website www.bya.bg;
  • “USER”, “SERVICE RECIPIENT” is any natural person who uses any of the services on the website www.bya.bg for personal use only for non-commercial purposes, provided that he/she complies with and complies with all copyrights and relevant notices;
  • “SERVICES” on the website includes access to information resources, registration for membership, news and events, training, courses and other activities of the association;
  • “MEMBER” – a natural or legal person who has become a member of the association through the website and has a “My Profile” profile on the website;
  • “MALICIOUS THIRD-PARTY ATTACKS” – actions or inactions of third parties that are contrary to the rules of Internet ethics, including, but not limited to DoS (Denial of Service – server overload), server intrusion, defacement, data theft, etc.
  • “DATA CONTROLLER” is a natural or legal person, public authority, agency or other structure that alone or jointly with others determines the purposes and means of the processing of personal data.
  • “PERSONAL DATA SUBJECT” – A data subject is a natural person who is identified or who can be identified on the basis of certain information.
  • “NEWSLETTER” – Each User, upon express consent, will receive information about promotional campaigns, new services, etc. When registering a user account, the User has the opportunity to choose whether or not to receive a newsletter. Bulgarian Yacht Association may send information messages, notifications and newsletters to Users who have expressly consented to this. Each User may at any time opt out of receiving these messages via the unsubscribe link contained in each email.

IV. Processing of personal data

The Association of www.bya.bg collects and processes personal data of the users of the website in strict compliance with the provisions of Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016. The Association of the website makes all necessary efforts to protect the personal data of the users of the site against unlawful processing. The Supplier processes the personal data of the Users on the basis of Art. 6, para. 1, b. “b” of the GDPR – the processing is necessary for the performance of a contract to which the data subject is a party or on the basis of Art. 6, para. 1, b. “a” of the GDPR – on the basis of the consent expressly provided by the User.

The Supplier has published information on the personal data processed and the purposes for which they are processed, as well as all information required under Regulation (EC) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data. of such data and repealing Directive 95/46/EC (GDPR) in the Privacy Policy, which is an integral part of the General Terms and Conditions.

V. Cookies

The website www.bya.bg uses cookies for the purpose of proper functioning, improving navigation and traffic analysis. The user can at any time limit or disable the use of cookies through his browser settings. Detailed information is contained in the separate Cookie Policy published on the website.

VI. Rights and obligations of the parties

  • Users do not have the right to generate excessive traffic on the website.
  • Users do not have the right to deactivate or disrupt the functionalities of the website and carry out malicious attacks.
  • The type and specifics of the possibilities for using the website may be changed unilaterally, at the discretion of the Supplier.
  • All users are granted the right to use the services of the site, solely for personal/non-commercial purposes, subject to applicable law and the requirements set forth in these General Terms and Conditions.
  • The content of the website is determined by the Supplier, who also has the right to change the content of its website at any time, including the content of these General Terms and Conditions and the Privacy Policy, adding and/or removing sections and/or materials at its discretion.
  • Access to the site may be temporarily suspended or restricted for the purpose of maintaining the site or introducing new services. Due to the nature of the Internet, uninterrupted access cannot be guaranteed.
  • The Supplier has the right to use cookies. Cookies are used for the purpose of optimization and ensuring full and quality use of the site’s functionalities.
  • Each recipient of the service is obliged, when using the access provided to the electronic platform:
    a/ To comply with Bulgarian legislation, applicable foreign laws, these General Terms and Conditions, Internet ethics, rules of morality and good morals;
    b/ Not to violate other people’s property or non-property rights, including intellectual or industrial property rights;
    c/ To immediately notify the Supplier of any case of committed or discovered violation of the law, these General Terms and Conditions and good morals;
    d/ Not to interfere with the proper functioning of the system and not to attempt to manipulate it, including, but not limited to: not to thwart the identification procedure of another recipient of the service, not to access beyond that granted to him, not to impair or impede the availability, reliability or quality of the access granted, as well as not to use it in a manner that causes refusal of its use;
    e/ Not to extract by technical means or in a technical manner information resources or parts of information resources belonging to the databases located on the website or on electronic devices, networks or media related to its operation, and thus not to create its own database in electronic or other form;
    f/ Not to commit malicious acts within the meaning of these General Terms and Conditions;

VII. Provision of services

The Association of www.bya.bg has the right at any time and without notice to make changes to the published services. It is possible that some of the information published on the site refers to services that are not currently offered and are not available. The Supplier is not responsible for technical errors in the presentation of the services.

VIII. Registration and access to profile

In order to use the services of the site, including to register as a member of the Bulgarian Yachting Association, the User must create his/her own profile by providing the necessary information.

The User is obliged to keep the confidentiality of his/her username and password and not to provide them to third parties. In case of suspicion of unauthorized access, the User must immediately notify the Bulgarian Yachting Association.

The Association is not responsible for damages caused by unauthorized access due to failure to comply with these requirements.

The Association has the right to terminate access to the profile in case of violations of these General Terms and Conditions, misuse of the services or provision of false information.

IX. Technical steps for membership application

To join the Bulgarian Yachting Association via the website www.bya.bg, follow the steps below:

  1. Visit the website www.bya.bg and click on the button or section “Join the Association” to open the application form.
  2. Enter personal data, including:
    – Name and surname;
    – Email address;
    – Contact phone number;
    – Address;
    – Additional data, if requested.
    Confirm that you have read and agree to the General Terms and Conditions and the Privacy Policy. Choose whether you wish to receive a newsletter about news and events.
  3. Click “Send application” or “Submit application”. You will receive an automatic confirmation email that the application has been received.
  4. A Bulgarian Yachting Association employee will review the submitted application. If necessary, the association may contact you for additional clarifications.
  5. After approval of the application, you will receive information for a bank transfer for the membership fee. Once the payment is confirmed, your membership is activated and you gain access to “My Profile” on the site.
  6. In your profile you can:
    a/ View and update your personal data
    b/ Follow events and news
    c/ Receive messages and notifications from the association.
    Note:
    Online payment through the site is currently not available. All membership fees are made by bank transfer.

X. Membership – rights and obligations

  1. By submitting an application for membership through the website www.bya.bg, the person expresses a desire to become a member of the Bulgarian Yacht Association and accepts its Statute and internal rules.
  2. Membership occurs after approval by the Management Board and payment of the relevant membership fee.
  3. Members have the right to:
    • Participate in events and initiatives of the Association;
    • Receive access to information and training provided for members;
    • Make proposals for improving the activities of the Association.
  4. Members are obliged to:
    • Comply with the Statute, General Terms and Conditions and decisions of the Association’s bodies;
    • Pay their membership fee regularly;
    • Keep their profile data up to date.
  5. The Bulgarian Yacht Association may terminate membership in the event of systematic violations or non-payment of membership fees.

XI. Links to third-party sites

The website www.bya.bg may contain special links to other websites maintained by third parties. The Supplier is not responsible for the legality, completeness, accuracy and up-to-dateness of the content of information resources of third parties to which electronic links from this website point, nor for the legality of the activities of these third parties.

XII. Copyright

All texts, photographs, audio/video materials, logos, graphic images, inscriptions and other resources uploaded to the website are subject to copyright under Bulgarian and international legislation – the Copyright and Related Rights Act and the Code of Private International Law, as well as the EU Regulations for the Protection of Copyright. Their copying, sharing, reproduction, distribution, broadcasting, transmission, modification or use in any other way leads to a violation of copyright and is subject to prosecution and violators are criminally liable within the meaning of the Criminal Code of the Republic of Bulgaria.

XIII. Limitation of liability

  • The Association of the site is not responsible for the subjective perceptions and interpretation of the accuracy, completeness and usefulness of the information resources of the site.
  • The Association of the site is not responsible for the information (including its completeness and reliability) contained in sites to which this site contains links.
  • The Association of the site has the right to compensation for all damages, expenses and claims of third parties that are a consequence of a violation of these general terms and conditions and/or unregulated use of the site’s services.
  • The Association of the site is not liable for any damages suffered by the user as a result of force majeure circumstances or those that are beyond his control and cannot be avoided – such as temporary interruption of access to the website due to technical reasons and others.
  • The Association is not liable for damages incurred by the User in connection with any impossibility or lack of access to this site.
  • The Association is not liable for the reliability and authenticity of the links published on this site.
  • The Supplier is not liable in the event of overcoming the security measures of the technical equipment and this resulting in loss of information, dissemination of information, access to information, restriction of access to information and other similar consequences.

XIV. Severability cause

The fact that a separate provision of these General Terms and Conditions is or may be declared illegal, invalid or unenforceable shall not result in the illegality, invalidity or unenforceability of the remaining provisions of the General Terms and Conditions.

XV. Applicable law

All issues not settled by these General Terms and Conditions shall be governed by the provisions of the current legislation of the Republic of Bulgaria.

XVI. Dispute resolution

All disputes arising from or relating to these General Terms and Conditions, including disputes arising from or relating to their interpretation, invalidity, performance or termination, as well as disputes regarding filling gaps in the General Terms and Conditions or their adaptation to newly arising circumstances, shall be resolved through understanding and mutual concessions.

Alternative dispute resolution /ADR/ between consumers and traders is an out-of-court conciliation procedure on a voluntary basis.
The general conciliation commissions assist in reaching an agreement between consumers and traders in disputes over contracts for the sale of goods and the provision of services.

XVII. Changes to the general terms

In view of the periodic additions and modifications of the Services, their improvement and expansion, as well as in connection with possible legislative changes that reflect on them, the General Terms and Conditions may be changed unilaterally by the Supplier. This change may also be made upon changing the type, nature or technology of the Services provided, upon termination of the provision of certain Services, as well as upon changing economic conditions.

When making changes to the General Terms and Conditions, the Supplier shall bring them to the attention of the Users by publishing them on the Supplier’s Website.
